How the Process Works
Trademark work is sequential by nature. Most matters begin with a search to identify potential conflicts and assess risk. If the mark appears viable, the next step is careful preparation and filing of the application with the USPTO.
After filing, applications typically wait several months before being reviewed by the government (USPTO). In most cases, initial review occurs 7–10 months after filing. During that review, the USPTO may approve the application, or it may raise questions or objections (via "Office Actions") that need to be addressed. Minor, procedural issues—such as clarifications or technical corrections—are often resolved quickly and are typically handled as part of our filing process. If the USPTO raises more significant concerns, those require additional analysis and are handled separately; in some cases, the issues cannot be resolved and the application does not proceed.
If an application clears examination, it is published for opposition, which allows others a limited time to object. If no opposition is filed, the USPTO issues a federal registration certificate. At that point, the trademark is officially registered, with nationwide rights and the ability to use the ® symbol.
